
As outlined below.
These term and conditions shall serve as a contract between Niseko Photography, KK, with respect to certain commissioned services for an individual, a group, or a third party booking Agent [hereinafter referred to as the “Client”}
Booking, Deposit & Payment. The Client’s preferred date of service can not be guaranteed until payment is made by either the Client or their booking agent. Payment for any services, in part or in whole, made by the Client or a third party constitutes the agreement of the following terms and conditions.
Cancellation. For general bookings, cancellations made thirty six [36] or more days before the scheduled date of service are fully refundable (less processing fees, transfer fees). Cancellations made between twenty two [22] and thirty five [59] days in advance of the scheduled date of service are subject to a refund amount of 50% of the total cost of the booking (less processing fees, transfer fees). Cancellations made less than twenty two [22] days before the scheduled date of service are subject to a cancellation fee of 100%. Refunds for cancellations will be processed within 14 days of the date of cancellation.
Injury/illness. No compensation will be made for any injury or illness incurred once the service has already commenced. Future services may be canceled, rescheduled or refunded at our discretion.
Adverse weather. Occasionally bad weather or dangerous conditions may lead to the decision to cancel a tour for both staff and client safety. We normally are able to head to other resorts to avoid such problems and Niseko Photography & Guiding reserve the right to make these decisions on grounds of Health & Safety. If the tour is cancelled at the decision of the guide, money will be fully refunded. If the tour is started and then cancelled at the decision of the guide due to bad weather or dangerous conditions, money will not be refunded but we will still try to make the most of the day. A cancellation fee may occur in some cases if customers cancel the tour for their own reasons as outlined below.
Client Impairment – Alcohol/Drugs. We want all of our guests to have a good time whilst visiting Hokkaido, however alcohol and drugs can impair your ability to safely ski, snowboard and even walk on the snow or icy roads safely. We reserve the right to cancel any service without refund if the guest is under the influence of alcohol or drugs.
Accident & Personal liability. Outdoor activities are inherently dangerous and are classed as a hazardous activities. As is walking on snow or ice covered slopes, streets, walkways, etc. Niseko Photography KK, cannot be held liable for any accident, injury, illness or minor or serious bodily harm or any injury or death that occurs prior, during or after an accident incurred during an outdoor activity service. Niseko Photography KK, cannot be held liable for any loss and/or damage of equipment or personal items prior, during or after an outdoor activity service.
Commencement of service. If the guest is not on time for the scheduled date and time of service, no time in addition to the originally scheduled duration of service will be added to the service. We understand that issues may arise and guests may be late for a service. If this happens, please contact the company representative or Sea And Summit Media’s director to notify them of the schedule change.
Travel insurance. All visiting international clients are required to have valid travel insurance that themselves for outdoor activities on and off the mountains. This includes snow sports, hiking, trekking, mechanised activities, or any other accident that may occur during the service or in transit to the service. We can put you in touch with our recommended insurance providers if needed.
